Terms of Service & Acceptable Use
These Terms are a legal agreement between you and muah-app LTD ("MUAH", "we", "us"), the operator of the MUAH mobile application (the "App"). By creating an account or using the App you agree to these Terms. If you do not agree, do not use the App.
Please also read our Privacy Policy, which explains how we handle your personal data.
1. What MUAH is
MUAH is a marketplace that connects clients ("Clients") with independent beauty professionals ("Service Providers") for makeup, hair, nail and related beauty services, delivered either at the Client's location or at the Service Provider's premises.
Our role. MUAH provides the technology platform and handles payments. We are an intermediary — we do not provide the beauty services ourselves. Service Providers are independent providers, not our employees, workers or agents. The contract for the beauty service itself is between the Client and the Service Provider. We are not a party to it, and we do not supervise, direct or guarantee the services a Service Provider performs.
2. Eligibility and your account
- You must be 18 or over to use MUAH. The App is not for anyone under 18.
- You must provide accurate information (including your date of birth, which we use to check you meet the age requirement) and keep it up to date.
- You are responsible for your account and for everything done through it. Keep your sign-in secure.
- One account per person. We may suspend or close accounts that break these Terms, that we reasonably believe are fraudulent or unsafe, or that are duplicates.
3. Service Providers — obligations and the limits of our checks
If you use MUAH as a Service Provider:
- You provide services as an independent business. You are responsible for the quality, safety and legality of your services, for your own tax and insurance, and for holding any licences, registrations and permissions the law requires where you operate.
- Licence and insurance declarations are self-declared. When required, you confirm ("attest") that you hold the licences/registrations and the public-liability and professional-indemnity insurance required in your jurisdiction. MUAH does not verify these declarations, does not collect or check your licence or insurance documents, and does not display a "verified" badge based on them. A declaration is your own representation, not an endorsement by MUAH.
- We do not carry out criminal-record or background (e.g. DBS) checks on Service Providers. Identity verification (via Stripe Identity), where completed, confirms identity only — not suitability, qualifications or safety.
- You must keep your availability accurate and honour accepted bookings.
For Clients: because vetting is limited as described above, please use your own judgement, and use the in-App safety features (see section 8). MUAH facilitates the introduction; it does not warrant any Service Provider's skills, qualifications, licensing or conduct.
4. Bookings
- A booking is a request that becomes a confirmed appointment when the Service Provider accepts it and any required payment or deposit is taken.
- The service details, price and any conditions are as shown in the App at the time of booking.
- You agree to communicate and transact through the App. Arranging to pay or continue off-platform is not permitted (see section 7).
5. Payments, fees and payouts
- Payments are processed by Stripe. Your card details are handled by Stripe and are not stored by MUAH.
- Client fees. A platform/service fee may apply to a booking, shown to you in the App before you confirm. Applicable taxes (e.g. VAT) may be added.
- Deposits and balances (scheduled bookings). For scheduled bookings, a deposit is taken when the booking is confirmed and the balance is taken automatically when the service is completed. The deposit amount depends on the Service Provider's cancellation-policy tier and is shown before you confirm.
- On-demand bookings. For on-demand bookings, payment is taken when you place the booking, in the amount shown to you before you confirm.
- Service-Provider commission and payouts. MUAH deducts a commission from the service price; the Service Provider receives the balance as a payout to their connected Stripe account after the service is completed. Commission rates and any subscription benefits are as set out in the App.
The specific fee, commission, deposit and tax figures are set out in the App and in our in-App pricing and cancellation disclosures, which may change from time to time. Those in-App disclosures, as versioned, form part of these Terms. We will show current figures before you confirm any payment.
6. Cancellations, no-shows and refunds
Cancellations and no-shows are governed by the cancellation policy shown in the App at the time of your booking, which is a versioned document that forms part of these Terms. In summary (the in-App policy prevails if there is any difference):
- Client cancellations. If you cancel before your booking is confirmed (that is, before a deposit is taken), no charge applies. After that, whether any part of the deposit is refundable depends on the Service Provider's cancellation policy shown in the App — typically there is a free-cancellation window, after which some or all of the deposit may be forfeited. The balance is not taken until the service is completed, so if you cancel beforehand there is no balance to refund. On-demand bookings may attract graduated fees depending on how far the Service Provider has already travelled or progressed.
- Client no-shows. If you do not attend, you forfeit the deposit only — never more. The balance is not taken.
- Service-Provider cancellations. If a Service Provider cancels, the Client is fully refunded. Service Providers who cancel may incur a fee that increases the shorter the notice, and repeated or short-notice cancellations may lead to restrictions or suspension.
Refunds are returned to your original payment method via Stripe.
7. Acceptable use
You agree not to:
- solicit or arrange bookings, payments or contact off-platform, or share personal contact details to move a transaction off MUAH (we mask contact details in messages and review attempts to circumvent this);
- harass, threaten, defraud, impersonate or discriminate against any person;
- upload unlawful, obscene, infringing, or unsafe content, or content you do not have the right to share;
- misuse, disrupt, scrape, or attempt to gain unauthorised access to the App or its systems;
- use MUAH for anything unlawful or for services that are unsafe or that you are not permitted to provide.
We use automated and human moderation to enforce these rules and may remove content, and warn, restrict, suspend or close accounts, where they are broken.
8. Safety
MUAH includes safety features for in-person appointments, including arrival confirmation and a one-time arrival code, and a graduated approach to sharing precise addresses (revealed only when a booking is accepted). These features assist your safety but do not guarantee it. MUAH does not provide an emergency or "panic" service and does not monitor appointments in real time. In an emergency, contact the emergency services. Please take sensible precautions when meeting or hosting someone for the first time.
9. Reviews and content
- You are responsible for content you post (portfolio images, messages, reviews) and confirm you have the rights to it.
- Licence to us. By posting content you grant MUAH a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content for the purpose of operating and promoting the App and the marketplace. This licence continues for content that remains part of another user's records (for example, a review left on a booking) even after you close your account, but is otherwise limited to running the service. You keep ownership of your content.
- Reviews must be honest and based on genuine experience. We may remove content that breaches these Terms.
10. Subscriptions (Service-Provider premium)
- Service Providers may purchase an optional premium subscription. Where this is sold through Apple's in-app purchase, payment is charged to your Apple ID, the subscription renews automatically unless cancelled at least 24 hours before the end of the current period, and your Apple ID is charged for renewal within 24 hours before the period ends.
- You can manage or cancel a subscription in your Apple ID settings. Refunds for Apple in-app purchases are handled by Apple under their terms.
- Premium features and prices are as described in the App and may change on notice for future periods.
11. Intellectual property
The App, its software, design, and the MUAH name and branding are owned by MUAH or its licensors. We grant you a limited, personal, non-transferable, revocable licence to use the App in accordance with these Terms. You may not copy, modify, distribute or reverse-engineer the App except as the law allows.
12. Liability
- Consumer rights. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — including liability for death or personal injury caused by negligence, for fraud, or for your statutory rights as a consumer that cannot be excluded.
- The service itself. Because the beauty service is provided by an independent Service Provider and not by MUAH (section 1), MUAH is not liable for the performance, quality, safety, or outcome of the beauty services, or for the acts or omissions of any Service Provider or Client. Your contract for the service is with the Service Provider.
- The platform. We provide the App with reasonable care and skill but do not guarantee it will be uninterrupted or error-free. To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss arising from matters outside our reasonable control.
13. Indemnity
To the extent permitted by law, you agree to indemnify MUAH against claims, losses and reasonable costs arising from your breach of these Terms, your misuse of the App, or (for Service Providers) the services you provide.
14. Suspension and termination
You may stop using MUAH and delete your account at any time from the App. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect users or the platform. Provisions that by their nature should survive termination (for example, payment obligations, content licences for retained records, and liability) will continue to apply.
15. Changes to these Terms
We may update these Terms. When we make significant changes we will update the version number and date, make the new version available in the App, and — where appropriate — ask you to accept the updated Terms before continuing. Your continued use after an update means the current version applies.
16. Governing law and disputes
These Terms and any dispute arising from them are governed by the laws of England and Wales, and are subject to the exclusive jurisdiction of the courts of England and Wales — save that, if you are a consumer resident elsewhere in the UK, you may also bring proceedings in your local courts, and mandatory consumer protections in your place of residence continue to apply.
